TERMS AND CONDITIONS OF SALE
EFFECTIVE: October 3, 2005

Terms of Payment:
A. Tarkett Sheet Vinyl, First Quality Current Patterns – 4%/15 Days, 2%/30 Days, Net 31.
B. All Seconds, Drops, and Specials – Net 30.
C. All other products – Net 30.

Delivery and Service Charges
A. A $49.00 delivery charge on all products delivered by Wheeler, Inc..
B. There will be no delivery charge for Mapei, Supply orders, Roppe products, and All     Cushion with the exception of No-Muv.
C. On all re-deliveries there will be an additional $49.00 charge.
D. Please call for truckload freight rates.

RETURN POLICY:
A. All merchandise should be inspected at the time of delivery, as acceptance indicates material was received in good order and was correct.
B. In the event Wheeler, Inc. makes an error in delivery we would like to be advised as soon as possible. We will arrange the time and date of pickup. Of course, there will not be a freight charge or restocking charge.
C. All returns to accommodate a customer’s request, will be subject to a $49.00 (minimum)
charge for outbound freight and a $49.00 (minimum) charge for inbound freight. A
restocking charge of 25% will apply to all returns.
D. The material must be in a saleable condition. Wheeler, Inc. reserves the right to reasonably deny any return for which in our judgment is not deemed saleable.
E. No orders cut by Wheeler, Inc. may be cancelled, after they have been cut.
F. No returns accepted on less than 5 cartons of tile, wood, or laminate within the same register.
G. No returns accepted on open cartons, cut and/or installed goods.
H. NO RETURNS ACCEPTED AFTER 30 DAYS.


Special and Custom orders CANNOT BE CANCELLED. All special and custom orders are subject to a deposit and credit approval.

Sales of Specials, Drops and Seconds CANNOT BE CANCELLED and are NON-RETURNABLE. Because of the nature of the products we cannot accept returns.

OPEN ORDER POLICY:
A. As an accommodation to our customers we keep an order open for a maximum of seven (7) days. After (7) days we will need to ship and invoice the material or cancel the order.

ALL PRICES ARE SUBJECT TO CHANGE WITHOUT NOTICE

IT IS THE RESPONSIBILITY OF THE DEALER TO DETERMINE WHICH ADHESIVE IS SUITABLE FOR EACH INDIVIDUAL INSTALLATION. WHEELER, INC. (AND/OR THEIR EMPLOYEES) ASSUMES NO RESPONSIBILITY OR LIABILITY FOR INCORRECT ADHESIVE USED WITH ANY PRODUCT.

IT IS THE RESPONSIBILITY OF THE DEALER TO MATCH MERCHANDISE RECEIVED WITH WHAT WAS ORDERED FROM WHEELER, INC. PRIOR TO DELIVERY TO THE END USER.
